Welcome to Cliqr, operated by AlphaQuest Innovate ("Cliqr," "we," or "us") at cliqr.shop and related applications (the "Service"). These Terms & Conditions ("Terms") are a binding agreement between you and Cliqr.
By creating an account, accessing the dashboard, operating a venue workspace, or using guest capture flows, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Service Overview
Cliqr helps hospitality venues collect guest-generated photos and videos via QR codes and links, verify guest contact information, apply AI-assisted quality and safety screening, manage content queues, connect social accounts for publishing, and engage guests through messaging channels including WhatsApp. Publishing to social networks is facilitated through integration with Scheduloid.
2. Venue Operators vs. Guests
Venue operators are business users responsible for their venue configuration, campaigns, team access, connected accounts, and compliance with laws governing marketing, data collection, and alcohol or other regulated offerings at their premises.
Guests are individuals who participate in capture flows. Guests must provide accurate information, grant required content licences at submission, and comply with venue rules and applicable law.
3. Eligibility
- You must be at least 18 years old to register a venue account or submit guest content.
- You must have authority to bind your organization if you register on its behalf.
- You must not have been previously suspended from the Service for breach of these Terms.
4. Accounts & Security
You are responsible for safeguarding credentials and for all activity under your account. Notify us immediately of unauthorized access. We may suspend accounts that pose security or abuse risks.
5. Guest Content Licence
By submitting content through a Cliqr capture flow, guests grant the venue and Cliqr a worldwide, non-exclusive, royalty-free licence to host, reproduce, modify (including cropping and formatting), display, publish, and distribute that content on social media and in marketing materials, as disclosed at the point of consent.
Guests represent that they own or have permission to submit the content, that it does not infringe third-party rights, and that it complies with platform and venue policies.
Venues must present clear, accurate consent language and may not misrepresent how guest content will be used.
6. Venue Operator Responsibilities
- Obtain all permissions required to run campaigns, display QR materials, and message guests
- Comply with applicable privacy, telecom, and marketing laws (including opt-in requirements for WhatsApp and SMS)
- Honor guest requests to stop marketing messages (e.g., STOP replies where supported)
- Ensure staff use role-appropriate access and do not share dashboard credentials
- Review AI moderation results before publishing; Cliqr does not guarantee post performance or platform approval
7. Acceptable Use
You may not use the Service to:
- Upload illegal, harassing, hateful, sexually explicit, or violent content
- Infringe intellectual property, privacy, or publicity rights
- Impersonate others or collect data without proper notice and consent
- Circumvent security, scrape the Service, or overload infrastructure
- Send spam or unsolicited messages in violation of law or carrier policies
- Reverse-engineer or resell the Service except as expressly permitted
We may remove content, reject submissions, or terminate access that violates these Terms or poses risk to users or platforms.
8. AI Moderation & Publishing
Automated screening assists venues but does not replace human judgment. Cliqr is not liable for false positives or negatives, rejected platform posts, or account restrictions imposed by social networks. Connected accounts remain subject to each platform's terms and API policies.
9. Scheduloid & Third-Party Services
Social publishing and token storage are provided through Scheduloid and underlying platform APIs. Your use of those services is also governed by their terms. Cliqr is not responsible for outages, policy changes, or data practices of third parties beyond our contractual arrangements with them.
10. Fees & Payment
Cliqr Enterprise is billed per venue at ₹25,000 per month plus applicable GST (18%), for a total of ₹29,500 per month after any free trial. New venues receive a 14-day free trial; you authorize recurring charges via PayU when starting the trial, but you will not be charged until the trial ends unless otherwise stated at checkout. You may cancel anytime before the first debit to avoid charges. After the trial, subscription fees renew monthly until cancelled. Payments are processed by PayU on behalf of Cliqr (AlphaQuest Innovate). Failure to pay may result in suspension of platform access. Refunds are not offered except where required by law.
11. Intellectual Property
Cliqr's software, branding, and documentation are owned by AlphaQuest Innovate or its licensors. Except for the limited rights granted in these Terms, no licence is granted to our intellectual property. Feedback you provide may be used without restriction to improve the Service.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIQR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) INR 10,000.
14. Indemnification
You agree to indemnify and hold harmless Cliqr and its officers, directors, and employees from claims arising from your content, your use of the Service, violation of these Terms, or violation of third-party rights.
15. Termination
Either party may terminate use as permitted by account settings or by contacting support. We may suspend or terminate access for breach or risk. Upon termination, your right to use the Service ends; provisions that by nature should survive will remain in effect.
16. Governing Law & Disputes
These Terms are governed by the laws of the Republic of India. Courts in Hyderabad, Telangana shall have exclusive jurisdiction, subject to mandatory consumer protections in your jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page. Continued use after the effective date constitutes acceptance.
